Complaint against Sahajanand Developers/Builders

I am staying in a New building called Vedant for the last 2 years. This building of approx 90 flats is a re-developed structure. Old structure was of only 20 houses having a Society. Builder has promised (in agreement) to admit all new buyers to the society and had asked to pay an Ad-Hoc maintenance and Property tax of Rs3.75 per sq-ft of Super Builtup area for a year in advance.

After a year, instead of admitting us in the society, he sent letters to all new members demanding much more money. We have got the Property Tax Invoice from BMC and found out that Builder is demanding much more Property Tax than actual invoiced by BMC. (Maintenance charge is being separately demanded by him).

We have formed a committee (represented by majority of new members) and have been writing to him to meet and discuss the situation to resolve it. Various times a couple of members have visited his office but builder has refused to meet. He continues to issue letters to members demanding money. We have been paying him as per our calculation.

Even the 20 old members (who are members of Society) are not willing to co-operate with us. Society is separately demanding RS40,000 per new member for admission; which is a separate issue we are facing. All this was not mentioned in our agreement with the builder.

We (new members) are fed-up with the attitude of the builder and wonder if there is any way we can complaint against him to put pressure on him to co-operate and resolve the problems. I await your response.

    There are certain issues in the matter.

    What is the role of the Builder in the Society?

    After the completion of the project the builder is supposed to hand over the reins of the building and its administration to the Society. Has this formality been completed?

    You have stated that there are about 90 flats. Out of this only 20 flat owners are members of the already formed society. The remaining 70 flat owners can explore the possibility of forming another society.

    Yes, you all can put pressure on the builder since you have everything in writing. The options are lodging a complaint with the police on the ground of cheating and also consider lodging a complaint with BMC.

    The above is not exhaustive and is subject to the provisions of the local laws prevailing in the State.

    You can expose the Builder and his malafied intentions on the internet by online complaints to let the more and more people to read.
