Complaint against HDFC Credit card for Home Loan EMI adjustment

My father owns an HDFC credit card for the past 2 years. Of late, HDFC bank charged his bank for delayed payment of credit card dues. My father refused to make the payment as well as other charges as he had informed the bank well before the due date that he had not received any statement for the current month.

My father has also taken out a housing loan with HDFC bank for which payment goes into a separate hdfc bank ac held at a different branch. In order to extract payment, HDFC bank has begun debiting the loan account ie. everytime I deposit money for payment of EMI’s their credit card dept. immediately debits that amount. As a result, my EMI cheques are returned dishonoured.

Please let me know if I have a case against the bank. Is the bank allowed to debit a clients account without any prior intimation and that too loan account.

    Banks claim that non-receipt of monthly statement does not constitute a valid ground for not paying the dues. The customer should be aware of his dues payable to the bank against the credit card account. Many of the banks are switching to eStatements which are sent to the customer’s email ids registered with them. However, before switching to eStatement, banks are required to take the confirmation from the customer or the customer should have voluntarily opted for this system. However, it is mandatory on the part of the banks to send statements to the customers regularly and on a timely basis.

    With regard to the second part of the complaint, we feel it is patently wrong on the part of HDFC bank to arbitrarily debit your housing loan a/c to settle the dues of credit card account. EMI cheques are issued with the sole purpose of clearing your housing loan and this should not be used for any other purpose by the bank.

    I suggest that you file a complain with banking ombudsman with RBI http://www.rbi.org.in/Scripts/bs_viewcontent.aspx?Id=159
