Complaint against Ebay for non-delivery

I have ordered a canon 50mm f/1.8 STM Lenses (item no-271938737337) from on 5th August 2015 and paid Rs. 6902.00 for the same by debit card through paisa pay id 39972577974 on the same day i.e 5th August 2015.

First they assured me that the product will be delivered by 10/08/2015. On 07/08/2015 they shipped the product through gojavas courier (Docket no: UNICRMC104075) and assured that I will get that product on or before 23/08/2015. When I tried to track my order, the courier company told that they returned the product to its origin. I informed the ebay customer care and they repeatedly told me to wait till 23/08/2015. If the product dose not reaches by the said time, they will initiate the refund.

Today is 23/08/2015 and I have not got the product yet. By this time, I have contacted the ebay customer care about ten times and they have repeated the same answer. My question is, I am the only one who thinks that ebay is cheating the customers? I have paid the amount 18 days ago and they are simply doing business by gathering capital this way from me and others.

I told them that I dont want a refund. I wanted the product and they have failed to deliver. I want to launch a case against and want my money back along with interest and penalty as they have cheated me. I have got all the mails, messages and screenshots as evidences. I am ready to go the last extent.
I hope you will be kind enough to help me to get justice.
