BPTP LTD, having office at BPTP Crest is not giving penality for delayed possession as per flat buyer agreement and are stating that as now possession has been taken and conveyence deed regd, they will not give penalty, which as per agreement is Rs 5 per sq ft per month for 1910 sq ft for delay of 36 months. The monthly penality at this rate is Rs. 9550/and for 36 months it will, be Rs. 3,43 ,800 /, which amount they should pay with interest. At the time of offering possession letter, the Company has fraudulently taken an undertaking making it as pre condition for giving possession, that buyer will not claim any amount from Company under any head. The terms of undertaking are contrary to terms of flat buyer agreement, which the Company is still relying on for claiming any amounts etc. Even after repeated phones and e mails in last 2 years the penality for delayed possession has not been given, which the buyer is entitled as per flat buyer agreement. The Company should be asked /directed to hounour its commitment as per flat buyer agreement and pay Rs 3,43,800/along with interest @ 18% P.A till date of payment,. at the earliest.
