Complaint regarding refund from Ebay

I ordered “Moto E 2nd Gen 4G Mobile Any Cdma Sim Evdo Data Hotspot (Tata, Mts)” and received an unsealed box of ‘Samsung GALAXY Note 3’. The seller contacted me after raising a claim, he said by mistake wrong product was shipped to me. He wanted me to ship back that product to him and he will send me the actual product that I ordered.

I didn’t agree as I lost my trust on this seller as he is selling open boxes of mobiles. Hence, I contacted eBay requesting my refund. The claim is raised on 25th July ‘2016. After several followups with eBay, on 06th August ‘2016, the wrong product was picked up from my location.

But, my refund is still not processed. Every time I contact eBay, they are asking me to wait 2-3 days to get communication from their claims department. The reverse picked up product is still not delivered to the seller as seller’s address is incorrect.

That clearly says that the seller is not a trustworthy candidate. But, eBay is still allowing him to sell through them. Please help me in getting back my money.
