I  had booked my flat in this above project in Jan 2011. My flat was booked with address as M tower flat number 901. It was supposed to be completed and possesion to be handed over by Dec 2012 as per the buyer/ builder agreement. Delay in posession resulting to penalty clause and penalty to be paid by builder at Rs 10/sq ft.
I was paid the penalty for the delay in posession from Jan 2013 to Sep 2013, but after that there is no penalty being paid and till date the flat possesion is not given to me.

When I met people at amrapali corporate office in sector 64 Noida, they informed me that since the NGT order was passed and therefore the construction could not be completed on time. The judgment came in May2014 and amrapali made the judgment retrospective from Oct 2013 on their own.

I met them and asked for a copy of the letter received due to which they had to stop the construction, but they have not provided any such letter to me. I have paid complete money to them for the posession but even the flat posession is not given yet.

I need 2 things from them.
a) compensation with interest on the penalty amount not paid from Oct 2013 to till date
b) Compensation for the rent which I am paying due to unavailability of house for me from Dec 2012 till date.

Please let me know how to proceed on this further. I am determined to take this case through consumer court as well.

    I have booked flat C9/704 in Amrapali Dream Valley, It had been delayed and there is no update from builder.
