Regarding House of Hiranandani, Bengaluru

I had booked an apartment with the House of Hiranandani in April 2010. After collecting 30% of the payment July 2010, they issued the sale deed in Sept 2011, more than a year after collecting the initial 30%. The sale agreement stated that the possession will be given after 30 plus 6 months for any delays i.e in 3 years. They collected 95% of the payments between the period 2012 ~2013 by claiming completion of slab level construction. Having collected 95% of the payment, the speed of construction became slow. Upon repeated enquries for the delay, they came up with several excuses such as delay due to rock blasting, public litigation filed by some people. Finally, in the month of Jan 2016, they started issuing the final demand notice for the remaining 5% amount and the registration amounts, club house charges, etc. This despite the fact that the higher floors in the apartments are still incomplete, the roads are still being constructed, there is no sign of a club house, many of the flats lack the basic amenities and worse of all, there is no occupancy certificate issued yet. HOH is holding the buyers to ransom by levying penalty on delayed payments, but does not offer even a single penny in compensation for the delay of almost 3 years. If the buyers had delayed the payment even by a single day, they levy 18% penalty and become ineligible for any compensation. Their compensation clause is very cleverly worded with words such “willful delay” which puts the onus on the buyers to prove that the builder willfully delayed the project. And the compensation which they offer for buyers who have not defaulted the payment even by a single day is a paltry Rs.3 per sq.ft for every month of delay. Till date, none of the buyers have received any compensation and instead are being asked to pay penalty for their delay in payments,even for a single day. This is the state of affairs with one of the premium builders in our country.

    Hi I also have an issue with the builder on booking amount refund if u want to give a consumer court complaint send me an email.
