Uber driver not returning the phone

I Boarded an Uber Cab (Maruti Suzuki Swift Dezire) at 09:37PM on 15 oct. 2017 from Burari delhi to ISBT Kashmiri gate & The cab driver name ashok. cab No. is – HR63C8608. I forgot My cell Phone In The car. I called to Mr Axxxk Then he confirmed. and he told me he returned phone with in a week but he did’t returned my cell phone. please help
