I have purchased a flat with builder and got the possession since 2012. There are about 200 flats made by developer. However the major issue is water gets flooded in the basement every year due to improper drainage design by builder leading to structural damage to building.
Now the builder wants to walk out of all responsibilities claiming 5 years period since handover. There is no society formed as yet because when developer tried to form society, nobody wants to take responsibility as the water flooding in basement during rains is terryfying. I have requested the developer to resolve this issue before handover but they claim it is local municipal issue. Can the builder or developer walk out without proper society formation or a handover?
