I have booked a flat in Gaur city-1, GC-5 , Noida Extn. in march 2010. i had paid 55% of total Flat Cost by may 2011. Since there was a land
Dispute in that area so bank has stopped the further disbursement till the final hearing/order of the court.
As per the direction/Guidelines of Hon’ Allahabad High Court dated 21st October 2011, The GNIDA has to obtain the NO Objection
Certificate From the respective National Capital region Planning Board (NCR Planning Board). The NCR Planning Board has given the NOC and advised to resume the Development/Construction w.e.f. 25-08-2012.
I received one letter with Demand from Gaur which says if you want to discontinue we can refund your total amount with 11% of interest if not then you need to sign the New agreement according to which there will be increase in FAR and possession postponed for 2 ear i.e Septemeber 2014.
I signed all the doc. and given them a check of all the interest pending i.e about 40K on 14 November 2012.
I had loan from Idbi Bank which was not disbursing at till Decemebr 2012. Bank has staretd disbursement by Jan 1st week and intrusted builder to raise fresh demand.
Gaur has raised one Reminder Cum Cancellation on 11-Jan-2013 and purposly send it on 14th Jan @ about 17.00PM . and cancelled my flat on 19th Jan.
Since then i am roaming to gaur to revive my flat and they are asking me new price i.e 3300/Sq. ft. I had approached to creadi for the same but how they will help me…. they are favouring the builder.
I am filling case against Gaursons in Allahabad High Court. I will fight to get the Justice.
